1. The Services
BRX Performance provides in-gym training, online training, athletic assessments, and related programs. Specific offerings, schedules, and pricing are described at the time of purchase or enrollment.
2. Eligibility and Minors
If you are under 18, a parent or legal guardian must agree to these Terms on your behalf and is responsible for your participation. A parent or guardian who enrolls a minor represents that they have the authority to do so.
3. Scheduling, Payments, and Cancellations
Fees are due as described at the time of purchase or enrollment. Specific membership, billing, scheduling, and cancellation terms are provided with your program or agreement. You are responsible for charges incurred under your account.
4. Text Messaging (SMS)
If you provide your mobile number and opt in, you agree to receive recurring automated text messages from BRX Performance at that number, which may include appointment, account, program, and promotional messages. Consent is not a condition of purchase. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out at any time, and HELP for help. Carriers are not liable for delayed or undelivered messages. Our handling of mobile and message data is described in our Privacy Policy.
5. Acceptable Use
You agree to use the website and Services lawfully and not to disrupt, misuse, or attempt to gain unauthorized access to our systems or other users' accounts.
6. Health, Safety, and Assumption of Risk
Athletic training involves physical activity and an inherent risk of injury. You should consult a physician before beginning any training program. By participating, you acknowledge and voluntarily assume the risks associated with physical training to the fullest extent permitted by law. You agree to disclose relevant health conditions and to follow safety instructions provided by our staff.

The website, training content, programs, and materials are owned by BRX Performance or its licensors and are protected by intellectual property laws. You may not copy, distribute, or create derivative works from our content without our written permission.
8. Disclaimers
The Services are provided on an "as is" and "as available" basis. We do not guarantee any particular athletic, performance, recruiting, or health outcome. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
9. Limitation of Liability
To the fullest extent permitted by law, BRX Performance will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or Services. Our total liability for any claim will not exceed the amount you paid to us for the Services giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless BRX Performance and its staff from claims and expenses arising out of your use of the Services or your violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules.
