Privacy Policy

BRX Performance LLC ("BRX Performance," "we," "us," or "our") operates brxperformance.com and provides athletic performance training services, including in-gym training, online training, assessments, and related programs (the "Services"). This Privacy Policy explains what information we collect, how we use it, and the choices you have.

1. Information We Collect

  • Contact and account information: name, email address, phone number, and mailing address.
  • Athlete and training information: age or date of birth, sport, position, performance metrics, assessment results, program and workout data, and any health, injury, or fitness information you choose to share with us.
  • Payment information: billing details needed to process payments. Card payments are handled by our payment processor; we do not store full payment card numbers.
  • Communications: text messages, emails, call records, and other messages exchanged with our team.
  • Technical and usage data: IP address, browser and device type, and how you interact with our website, collected automatically through cookies and similar technologies.

2. How We Use Your Information

  • Provide, schedule, and operate the Services.
  • Process payments and manage your account.
  • Communicate with you about appointments, programs, billing, and support, including by text message where you have opted in.
  • Personalize training and track progress.
  • Improve our Services and develop new offerings.
  • Measure how our advertising performs and show our ads to people who may be interested in our Services, as described in Section 5.
  • Maintain security, prevent fraud, and comply with legal obligations.

3. Text Messaging (SMS)

BRX Performance offers text-message (SMS) communications to people who provide their mobile number and opt in to receive them.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.. We may share this information only with service providers (e.g., carriers, messaging platforms) to operate our SMS program. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out; HELP for help.

Opting in to text messages is not a condition of purchasing any product or service. For questions about our SMS program, contact info@brxperformance.com. 

4. How We Share Information

We do not sell your personal information. We share information only as needed to operate the Services, with categories of service providers such as:

  • Payment processing (to bill for Services).
  • Scheduling and customer relationship management (for example, HubSpot).
  • Messaging platforms and carriers (for example, Salesmsg) to operate our SMS and communications.
  • Website hosting and analytics (to run and maintain our site).
  • Advertising and measurement partners (for example, Meta, which operates Facebook and Instagram), as described in Section 5.

Service providers may use your information only to perform services for us. Advertising partners use the information we share under their own terms and policies, as described in Section 5. As stated above, we do not share mobile numbers, SMS consent, or message data with third parties or affiliates for their own marketing or promotional purposes. We may also disclose information if required by law, legal process, or government request, or to protect the rights, safety, or property of BRX Performance, our customers, or the public.

5. Advertising and Measurement

We advertise on Facebook and Instagram, which are operated by Meta Platforms, Inc. ("Meta"). To understand which of our ads work and to show our ads to people who may be interested, we use Meta's advertising tools, including the Meta Pixel on our website and Meta's Conversions API. Through these tools we may share:

  • Website activity: pages you visit on our website and actions you take there, such as submitting a form or booking an appointment, along with technical data such as your IP address, browser type, and cookie identifiers.
  • Ad response events: if you contact us through one of our ads, we may tell Meta when you reach certain steps with us, such as booking a call or becoming a customer.
  • Customer lists: we may share contact lists so that Meta can show our ads to existing contacts, keep our ads from being shown to current customers, or find people with similar interests.

When we share your email address, name, or location for these purposes, it is converted into an encrypted (hashed) form before it is sent, so it can be matched but not read.

We do not share mobile phone numbers, text messaging consent, or message content with advertising partners. We do not share information about athletes under 18, or any health, injury, performance, or assessment information, with advertising partners.

Meta uses this information under its own terms and policies, including the Meta Privacy Policy. You can adjust the ads you see in your Facebook and Instagram ad settings. To ask us to stop including your information in advertising matching, contact us at info@brxperformance.com.

6. Data Security

We use reasonable, industry-standard measures to protect your information, including encrypted connections (HTTPS/TLS) and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Data Retention

We retain your information for as long as your account is active or as needed to provide the Services, and afterward as required for legitimate business purposes or to comply with our legal obligations.

8. Children's Privacy

We provide training services to minors. When a participant is under 18, we collect and use their information with the involvement and consent of a parent or legal guardian. We do not knowingly collect personal information from children under 13 without verifiable parental consent. We do not share information about athletes under 18 with advertising partners. A parent or guardian may contact us to review, update, or request deletion of their child's information.

9. Your Choices and Rights

  • Access, correct, or request deletion of your personal information.
  • Opt out of marketing emails using the unsubscribe link in those emails.
  • Opt out of text messages at any time by replying STOP.
  • Ask us to stop including your information in advertising matching (see Section 5).

10. Cookies and Tracking

Our website uses cookies and similar technologies for essential functions, to understand site usage, and to measure our advertising, including the Meta Pixel described in Section 5. You can control cookies through your browser settings.

11. Third-Party Links

Our website may link to third-party sites we do not control. This Privacy Policy does not apply to those sites, and we encourage you to review their privacy policies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you.
