BRX Performance LLC ("BRX Performance," "we," "us," or "our") operates brxperformance.com and provides athletic performance training services, including in-gym training, online training, assessments, and related programs (the "Services"). This Privacy Policy explains what information we collect, how we use it, and the choices you have.

1. Information We Collect

  • Contact and account information: name, email address, phone number, and mailing address.
  • Athlete and training information: age or date of birth, sport, position, performance metrics, assessment results, program and workout data, and any health, injury, or fitness information you choose to share with us.
  • Payment information: billing details needed to process payments. Card payments are handled by our payment processor; we do not store full payment card numbers.
  • Communications: text messages, emails, call records, and other messages exchanged with our team.
  • Technical and usage data: IP address, browser and device type, and how you interact with our website, collected automatically through cookies and similar technologies.

2. How We Use Your Information

  • Provide, schedule, and operate the Services.
  • Process payments and manage your account.
  • Communicate with you about appointments, programs, billing, and support, including by text message where you have opted in.
  • Personalize training and track progress.
  • Improve our Services and develop new offerings.
  • Maintain security, prevent fraud, and comply with legal obligations.

3. Text Messaging (SMS)

BRX Performance offers text-message (SMS) communications to people who provide their mobile number and opt in to receive them.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.. We may share this information only with service providers (e.g., carriers, messaging platforms) to operate our SMS program. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out; HELP for help.

4. How We Share Information

We do not sell your personal information. We share information only as needed to operate the Services, with categories of service providers such as:

  • Payment processing (to bill for Services).
  • Scheduling and customer relationship management (for example, HubSpot).
  • Messaging platforms and carriers (for example, Salesmsg) to operate our SMS and communications.
  • Website hosting and analytics (to run and maintain our site).

These providers may use your information only to perform services for us. As stated above, we do not share mobile numbers, SMS consent, or message data with third parties or affiliates for their own marketing or promotional purposes. We may also disclose information if required by law, legal process, or government request, or to protect the rights, safety, or property of BRX Performance, our customers, or the public.

5. Data Security

We use reasonable, industry-standard measures to protect your information, including encrypted connections (HTTPS/TLS) and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your information for as long as your account is active or as needed to provide the Services, and afterward as required for legitimate business purposes or to comply with our legal obligations.

7. Children's Privacy

We provide training services to minors. When a participant is under 18, we collect and use their information with the involvement and consent of a parent or legal guardian. We do not knowingly collect personal information from children under 13 without verifiable parental consent. A parent or guardian may contact us to review, update, or request deletion of their child's information.

8. Your Choices and Rights

  • Access, correct, or request deletion of your personal information.
  • Opt out of marketing emails using the unsubscribe link in those emails.
  • Opt out of text messages at any time by replying STOP.
